Here’s how changes to negative gearing laws could affect property investors

Australian landlords are grappling with major changes to negative gearing laws that would limit the ability to reduce their annual tax through loss-making investment properties.

While details of what changes to existing negative gearing laws are still being considered, the potential for changes to rental losses being tax deductible is on the cards.

The federal Treasury has admitted to modelling possible changes to negative gearing, which could include a cap placed on the number of properties a landlord can negative gear to just two.

It comes after the Grattan Institute made a submission to the government late last year recommending reforming negative gearing due to the distortion in the property market as the independent public policy think tank looks for ways to bring more housing supply into the market.

The potential for changes to the already contentious negative gearing laws comes as the government looks for ways to bring more equity into the nation’s housing market.

The back story

Negative gearing was introduced 25 years ago to stimulate the investment market nationally.

But as the government looks for measures to balance the federal budget, the tax break could be on the chopping block.

As it stands, landlords can offset losses from property ownership against other forms of income, which could provide significant savings on an annual tax bill.

While making a loss on an investment property doesn’t sound ideal, some investors use this strategy for tax purposes, knowing that they can offset their loss against other income, such as their salary.

Equitable housing

But some argue that the national debate on housing affordability has become distracted by investor-focused tax settings.

Making changes won’t result in new homes being built, which the nation desperately needs to meet the current housing shortfall of 1.2 million homes over the next five years.

Between land tax, stamp duty and council rates, property investors carry a disproportionate level of tax when contrasted against sharemarket investors. The public conversation needs to shift from investor blame to structural reform, she said.

“Property investors are widely viewed as scapegoats for additional taxes, and the unintended consequences of such targeted taxation will be damaging to the property market as a whole,” she said.

Tax break

Meanwhile, accounting body CPA Australia notes that negative gearing is often debated only in terms of residential property, but the broader principle of deducting losses is a long-standing feature of Australia’s tax system and requires careful consideration before any redesign.

The accounting body’s tax lead Jenny Wong is concerned that tweaking negative gearing in isolation could risk pushing further pressure into the rental market or distort investment decisions.

She said many Australians use a mix of assets to build long-term financial security, including investments held outside superannuation. They deserve a fair go, and their hard-earned savings should not be undermined by fragmented or short-term tax changes.

“Any reform should prioritise stability, integrity and transitional fairness, and avoid settings that unintentionally advantage those with access to sophisticated structures,” Ms Wong said.

Treasurer Jim Chalmers will consider changes to tax measures, with an announcement expected as he hands down the budget in May.

He has not spoken publicly about his plans at this stage, only saying that Treasury is looking into changes to negative gearing, among other policies.

Many airports have been grappling with massive security lines as spring break travel kicked off over the weekend amid a Department of Homeland Security (DHS) funding lapse.

Houston ‌Hobby Airport in Houston, Texas, had lines lasting an average of 3.5 hours at one point Sunday — while Louis Armstrong New Orleans International Airport in Louisiana told passengers to arrive at least three hours before their flights, Reuters reported.

Lauren Bis, DHS Deputy Assistant Secretary for Public Affairs, told Fox News Digital in a statement the delays are “severe fallout” from the “Democrat shutdown” of DHS.

“Today, travelers are facing TSA lines of up to nearly 3 hours long at some major airports, causing missed flights and massive delays during peak travel,” said Bis.

“These frontline heroes received only partial paychecks earlier this month and now face their first full missed paycheck, leading to financial hardship, absences and crippling staffing shortages.”

A TSA spokesperson told Fox News Digital passengers should arrive “as early as possible” to avoid missing their flights.

“As staffing constraints arise, TSA will evaluate on a case-by-case basis and adjust operations accordingly,” said the spokesperson.

Airport wait times are expected to increase as the shutdown continues — leaving TSA officers in a troubling spot.

A trade association representing major U.S. airlines said flights were delayed and passengers missed flights due to long security lines, according to Reuters.

“Congress and the administration must ​act with urgency to ⁠reach a deal that reopens DHS and ends this shutdown. America’s transportation security workforce is too important to be used as political leverage,” said Airlines for America CEO Chris Sununu in a statement.

Sununu said TSA officers will receive their first empty paycheck on Friday, according to Reuters.

TSA official Ha Nguyen McNeill told Congress in February that roughly 1,110 transportation security officers left the agency in October and November 2025 amid the 42-day government shutdown, Reuters reported.

Boston-based traveler Eliana Patterson told Reuters that the security lines at the New Orleans airport wrapped throughout the terminal, reaching out through an exit into a nearby parking lot.

Travelers struggled with hours-long security lines at some airports as officials warned of Transportation Security Administration staffing shortages amid the partial government shutdown.

Houston’s William P. Hobby Airport told customers Sunday to arrive as early as 5 hours before their flights, and warned that security wait times could exceed three hours.

The partial government shutdown has meant that TSA officers are working but without regular paychecks.

TSA callouts rose during the 2018-2019 government shutdown, prompting the closure of some checkpoints and leading to longer screening lines. It ended hours after a shortfall of air traffic controllers curtailed flights on the East Coast. The current shutdown, however, is affecting only Department of Homeland Security employees, including TSA officers.

Hartsfield-Jackson Atlanta International Airport, the world’s busiest, as well as Louis Armstrong New Orleans International Airport, said travelers should arrive at least 3 hours early because of the disruptions.

“Due to impacts from the federal government’s partial shutdown, there is a shortage of TSA workers at the security checkpoint,” New Orleans’ airport said on a post on X. “The Airport has staff on hand to help keep the lines organized, and we will continue to coordinate with our federal partners with the TSA as they navigate this issue.

Sunday’s disruptions rattled the airline industry and travelers just as the busy spring-break travel period gets underway.

“Airlines have done their part to prepare; now Congress and the administration must act with urgency to reach a deal that reopens DHS and ends this shutdown,” Chris Sununu, chief executive of Airlines for America, an industry group that represents American Airlines, Delta Air Lines, Southwest Airlines, United Airlines, and others, said in a statement. “America’s transportation security workforce is too important to be used as political leverage.”

The disruptions come as airlines are grappling with the fallout of the U.S. and Israel’s attacks on Iran, which have led to thousands of canceled flights and driven up the cost of fuel, their biggest expense after labor.
